This page contains the Acceptable Use Policy for Email ("AUPE") under which all ENTP Mail clients (collectively, "Client") use Email Services. The client acknowledges and agrees to be bound by all the terms, conditions, and policies of the AUPE as set forth herein, including any future amendments. The client acknowledges and agrees that he is responsible for continual compliance with this policy to ensure the integrity, security, and reliability of the Email Services and their networks, systems, facilities, and data.

Sending Spam

Clients may not send or attempt to send unsolicited email messages ("Spam"). Spam is not only annoying to Internet users, but it also violates many laws and seriously affects the efficiency and cost-effectiveness of Email Services. Sending Spam can lead to an industry blacklisting of the client's business and mail servers, resulting in interruption or termination of email services.

Specifically, Client agrees not to:
  • Send, or attempt to send, Spam of any kind from the Service Provider Network.
  • Send, or attempt to send, Spam of any kind from third-party networks using a return email address that is hosted on the Service Provider Network, or referencing an email address hosted on the Service Provider Network.
  • Send email messages which result in complaints from the recipient or the recipient's email provider, or blacklisting of the sender's email address or mail server.
  • Send email messages which are excessive or intended to harass or annoy others.
  • To continue sending an email to a recipient that has indicated that he does not wish to receive it.
  • Take any actions intended to cloak the Client's identity or contact information, including but not limited to intentionally omitting, deleting, forging, or misrepresenting message headers or return addresses.

In the absence of positive, verifiable proof to the contrary, Service Provider considers complaints by recipients of emails to be de-facto proof that the recipient did not subscribe or otherwise request the email(s) about which a complaint is generated.

Sending "Opt-in" Bulk Email (Permission based)

Clients may not use the Email Services to send "Opt-in" Bulk Emails. Service Provider defines "Opt-in" Bulk Email as email messages of similar content sent to more than 250 recipients within a relatively short period. The term "Opt-in" means that the recipients have signed up to receive the emails voluntarily and implies that the Bulk Email is not Spam. Service Provider has measures to prevent Bulk Email from being sent through its servers, or attempt to do so may not be delivered and may result in interruption or termination of the client's email services. Attempts to circumvent this Bulk Email restriction by breaking up bulk mailings over a while or by sending from multiple email accounts will itself be considered a violation of this policy.

The Service Provider Network is not to process bounce messages for Bulk Emails. Therefore, the clients may not send Bulk Emails from third-party networks using a return address hosted on the Service Provider Network unless the clients take extreme care to prevent more than 100 bounce emails from arriving at the Service Provider Network.p>

Illegal Use

Email Service may only be used for lawful purposes. For example, the clients may not use the Service Provider Network to create, transmit, distribute, or store content that:

  • Violates a trademark, copyright, trade secret, or other intellectual property rights of others.li>
  • Violates the regulation of export control laws
  • Violates the privacy, publicity, or other personal rights of others.
  • Impairs the privacy of communications.
  • Contains obscene, offensive, unlawful, defamatory, harassing, abusive, fraudulent, or otherwise objectionable content as reasonably determined by Service Provider.
  • Encourages conduct that would constitute a criminal offense or give rise to civil liability.
  • Constitutes deceptive online marketing.
  • Violates reasonable regulations of the service provider or other service providers.
  • Causes technical disturbances to the Service Provider Network, its partner networks, or the network used by the client to access the Email Services, or violate the policies of such networks, including, but not limited to, the intentional introduction of any viruses, trojan horses, worms, time bombs, cancel-bots or any other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system or data.
  • Assists, encourage, or permits any person to engage in any of the activities described in this section. If the client becomes aware of any such activities, the client is obligated to immediately notify Service Provider and take all other appropriate actions to cause such activities to cease.

Content

The client is responsible for all content transmitted, received, and stored by the Service Provider through email services. Service Provider takes no responsibility for content passing through or stored on the Service Provider Network, including but not limited to viruses, mail floods or other disabling features, or content provided on third-party websites linked to by content passing through or stored on the Service Provider Network. Service Provider does not adopt, nor warrant the accuracy of, the content of any linked Web site and undertakes no responsibility to update the content. Use of any information obtained via the Service Provider Network is at its own risk.

AUP Breach

If Customer breaches the AUP (including unintentionally, resulting from the use of reasonable security precautions, or as a result of activity occurring without Customer authorization) company may block any content or traffic, suspend the Services, or terminate the Services in compliance with the Agreement. No credit shall be available under any Service Level Agreement for interruptions of Services resulting from AUP breach. Use of the Services to assist another person in an activity that would breach this AUP if performed by Customer is an AUP breach.

Payment Policies

All accounts are set up on a pre-pay basis. Setup fees are charged for all new accounts and major account changes and are non-refundable. All pricing is guaranteed for the term of pre-payment. ENTP Mail reserves the right to change prices at any time, unless other terms have been agreed upon. Credit card accounts are subject to login deactivation upon the card declining for charges within 48 hours of email notification. Any account not brought current within a week (7 days) of e-mail notice or exceeding this time frame in any way is subject to complete account deactivation. The customer is responsible for all money owed on the account from the time it was established to the time that the customer notifies ENTP Mail via email at billing@entp.email to request for termination of services. ENTP Mail will bill each client Rs.100/- to Rs.150/- per returned check depending on the bank. All ENTP Mail accounts are setup on anniversary billing cycles. Your particular billing cycle corresponds to the contract length that was initially chosen at setup. All taxes, fees and governmental charges relating to the Services provided hereunder (other than income taxes of ENTP Mail) shall be paid by Customer. ENTP Mail accepts paper checks from customers for payment of web hosting services and fees associated with your account.

Cancellation

ENTP Mail reserves the right to cancel service at any time. All fees paid in advance of cancellation will be pro-rated and paid by ENTP Mail if ENTP Mail institutes its right of cancellation. Any violation of policies which results in extra costs will be billed to the customer (i.e. transfer, space etc.) Cancellation refunds will be made by company check or issued back to your credit card within 30 days of receipt of cancellation. Cancellations are processed only from 9:30 a.m. – 6:30 p.m. IST on Monday-Saturday. No cancellations are processed on holidays or weekends.

Liability and Obligations on Cancellation

If the Agreement expires or is cancelled for any reason, ENTP Mail is not liable to you because of the expiration or cancellation for compensation, reimbursement or damages on account of the loss of prospective profits, anticipated sales, goodwill or on account of expenditures, investments, leases or commitments in connection with your business, or for any other reason whatsoever flowing from the termination or expiration. If you terminate this Agreement, ENTP Mail will not relieve you of any obligations to pay fees and costs accrued before the termination date or any other amounts you owe to ENTP Mail under this Agreement.
